Terms and Conditions

Products are sold by FRANTOIO ANTICA TUSCIA BATTAGLINI S.r.l | Via Cassia, km 111,700 Bolsena (VAT No. IT 02255350569), owner of the site and domain (hereinafter referred to as the Seller).

Before placing an order, the Buyer must carefully read these General Terms and Conditions of Sale, which are available on the website: frantoiobattaglini.com – so they can be stored and reproduced.

1a. APPLICABILITY OF THESE TERMS OF SALE

• The General Terms and Conditions of Sale exclusively govern the offer, submission, acceptance and execution of purchase orders for products and services offered on the site https://www.frantoiobattaglini.com

• All prices include I.V.A. / V.A.T. / T.V.A. / MwSt.
• Definition in Italian: Imposta sul valore aggiunto.
• Definition in English: Value-added tax.
• Definition in French: Taxe sur la valeur ajoutée.
• Definition in German: Mehrwertsteuer.

2. CONCLUSION OF THE CONTRACT

1. The purchase order is made by the Buyer sending the “order form” (also called “Shopping Cart”) in electronic format for one or more products, and by sending said order form to the Seller electronically, following the relevant instructions.
2. The order form contains: a reference to these General Terms and Conditions of Sale and the withdrawal information, a summary of the essential characteristics of each product ordered and its price (including all applicable taxes and costs), a list of accepted payment methods and methods of delivery of the purchased products, shipping and delivery costs, as well as the conditions for exercising the right of withdrawal and the methods and times for returning purchased products.
3. Before proceeding with the purchase via submission of the order form: the Buyer must carefully read the General Terms and Conditions of Sale and the withdrawal information, and is also responsible for verifying the accuracy of the entered data and correcting any errors.
4. Product prices may be subject to updates and changes. The Buyer is obliged to check the final sale price before submitting the order form.
5. By submitting the order form, the Buyer declares that they have understood and accepted its contents, as well as the General Terms and Conditions of Sale and Use, the Privacy Policy, and the right of withdrawal regulations. Failure to fully accept these contents will render the order inadmissible. The contract is considered concluded upon acceptance of the order by the Seller, after verification of the correctness of the data. Such acceptance will be communicated to the Buyer by a confirmation email to the email address provided.
6. Once the contract is concluded, the Seller will process the purchase order and the Buyer may view placed orders by accessing their profile in the following section: https://frantoiobattaglini.com/mio-account/orders/
7. The Seller reserves the right not to proceed with purchase orders that are incomplete or incorrect, that are not accompanied by successful payment, or in case of product unavailability. In these cases, the Seller will inform the Buyer by email of the above impediments and will refund any amounts already paid within the legal time limits, without further compensation.

In such cases the contract is deemed terminated by operation of law.

In those instances, the Seller will notify the Buyer, within ten (10) days from the day following the order submission, of the contract termination.

3. PRODUCT INFORMATION

1. The essential characteristics of the products listed on the site are provided on each product’s page.
2. The representations of the products on the site correspond to the photographic image of the products themselves. This image is intended only to generally present the products and the Buyer is therefore aware that it may not be exactly representative of every product feature, as differences in color and size may exist. In any case, reference must be made to the literal description of the product.

4. PAYMENTS

1. Payment methods: the Buyer may pay the price of the products and related delivery costs by Credit Card, Nexi, or bank transfer.
2. Credit Card
   Payment networks accepted: MasterCard, Visa, Maestro.
   For maximum security, the Buyer will make the payment transaction directly on the secure Nexi server.
3. The site does not store the Buyer’s credit card number; however, thanks to the protected communication system of the relevant credit institution, from the second purchase onward the Buyer may proceed without re-entering their data. The credit institution uses SSL protocol to encrypt data transmitted between its server and the Buyer’s browser.
4. Bank Transfer
   Within a few minutes of placing the purchase order, the Buyer will receive by email a summary of the order and instructions for payment via bank transfer. The requested goods will not be shipped until funds have been received in the Seller’s bank account.

5. ORDER RECEIPT CONFIRMATION

Once the order is received, the Seller will verify stock availability for order fulfillment. If a product is not available, Customer Service will notify the Buyer, who may decide to confirm or cancel the shipment.

At the time of contract execution, the Buyer will receive an email confirming receipt of the purchase order. The communication contains a summary of the general and particular conditions applicable to the contract, the right of withdrawal, the order number, shipping and billing data, list of ordered products with their essential characteristics, price and amount paid.

6. SHIPPING, DELIVERY AND EXPORT

Purchased products will be delivered to the address indicated by the Buyer during the purchase process.

The Seller will issue an invoice for the shipped goods for each order placed, sending it to the Buyers in digital or paper format only upon request via email at oliodibolsena@frantoiobattaglini.com or by phone at +39.0761 798847 from Customer Service. Invoice data cannot be modified after issuance.

Delivery costs are borne by the Buyer and are clearly specified during the purchase process.

All purchases are delivered by express courier from Monday to Friday, excluding holidays. The Seller is not responsible for unpredictable delays.

Once products are shipped, the Buyer will receive a confirmation email.

Except in cases of force majeure, ordered products will be delivered within 7 (seven) working days from the day following the order, unless the Buyer receives – within the same period – notification of inability to deliver due to product unavailability. In such a case, the Buyer may choose one or more alternative products. If the Buyer decides not to choose alternatives or to cancel, the Seller will refund any amounts already paid within the same timeframe.

If the Buyer wants to specify a new delivery address, they must contact Customer Service, which will authorize the courier accordingly.

Delivery cost is calculated based on the weight of items in the cart at checkout and the geographic shipping area. For shipments to the Netherlands, an extra fee equal to 50% of the total product value is applied as general export costs.

7. RIGHT OF WITHDRAWAL, RETURNS AND REFUND

Pursuant to Article 49 of the Consumer Code (Legislative Decree 21/2014), the Buyer has the right to withdraw from the purchase agreement for any reason, without explanation and without penalty.

To exercise this right, the Buyer must send communication to the Seller within 14 working days from the date of receipt of the goods.

This communication must be sent by registered letter with return receipt addressed to:
FRANTOIO ANTICA TUSCIA BATTAGLINI S.r.l | Via Cassia, km 111,700 Bolsena, ITALY; or by email to: oliodibolsena@frantoiobattaglini.it. Email communication must also be sent within the same 14 working‑day period and followed by a confirmation via registered letter.

Customer Service will provide instructions on returning the goods upon receipt of the communication.

Conditions for withdrawal:
A. The right applies to the entire product purchased; partial withdrawal is not possible.
B. Return shipping costs are borne by the Buyer.
C. Until confirmation of receipt at our warehouse, shipment is the sole responsibility of the Buyer.
D. The Seller is not liable for damage or loss of goods returned via uninsured shipping.
E. If goods are damaged during transport, the Seller will inform the Buyer of the event (within 5 working days) to allow filing a claim with the courier for possible compensation. In this case, the product will be made available for return, and the withdrawal request will be cancelled.

The Seller will refund the amount paid within 30 days of the goods’ return, by refund to the credit card or by bank transfer. The Buyer must provide IBAN details for the refund.

The right of withdrawal lapses if the essential condition of product integrity (packaging and/or contents) is missing when the Seller finds:
1. Absence of external packaging and/or product wrapping
2. Damage to the product for reasons other than transport.
If withdrawal lapses, the Seller will return the item to the sender and charge them for shipping costs.

1. Free Return
   The Seller offers Clients the possibility of replacing purchased Products via the Site.
   The Buyer who is not fully satisfied must keep all delivery documentation and the Product in its original packaging and contact the Seller via email at oliodibolsena@frantoiobattaglini.it or call +39.0761 798847. Customer Service will arrange product pickup with the Buyer.

8. CONFORMITY DEFECTS

If products exhibit conformity defects, the Buyer must immediately contact oliodibolsena@frantoiobattaglini.it

The legal warranties provided by Articles 129, 130 and 132 of the Consumer Code apply. The Buyer is entitled to restoration of conformity at no cost via repair or replacement or to a reasonable price reduction or contract termination. The Buyer forfeits these rights if the defect is not reported to the Seller within two months of discovering it.

Any liability for damages or failures to fulfill orders, total or partial, is excluded.

9. ERRORS

Although product information on the site is regularly updated, complete accuracy cannot be guaranteed.

The Seller reserves the right to correct errors, inaccuracies or omissions even after an order has been placed, or to modify or update information at any time without prior notice.

11. APPLICABLE LAW AND JURISDICTION

The sales contract for products on https://www.frantoiobattaglini.com is deemed concluded in Italy and governed by Italian law. For disputes arising from this distance sales contract, if the Buyer is a consumer, territorial jurisdiction is that of the court where the Buyer resides or elects domicile within Italy; otherwise jurisdiction is exclusively Viterbo.

These General Terms and Conditions of Sale may be amended, also in consideration of any regulatory changes.
